LEGAL DRINKING AGE

Seeing the fact that Belgian Beer Factory mainly offers alcoholic products, you are obliged to be at least 18 years old. Meaning, if your country allows 16 or 17 year old customers to drink alcoholic beverages, we will still not allow you to order at our store. You have to be at least 18 years old.

Most governments have implemented these rules in order to protect the youngsters from the dangers of alcohol. Obviously we fully support, and more importantly, follow these rules. Are you still not convinces? Please read this overview :

  • If you are underage, consuming alcoholic beverages is extremely hazardous to your developing body.
  • The younger you start drinking alcoholic beverages, the higher the chance you will face an alcohol addiction when you are older.
  • Youngsters (minor 18 years old) are more likely to get a alcohol poisoning. 
  • ... and many, many more reasons why not to drink before your 18th birthday. 
If you are not of this legal drinking age (18), we forbid you to access our websites, platforms, networks etc. Since these websites, platforms, social networks etc. are our own property, we have the ability to ban you from this site. This is the reason why you have to confirm whether or not you are of the legal drinking age (18) when entering our shop. By confirming this, you take full responsibilty of visiting our online shop. If you confirm to be older than 18 years old, but actually you are not of legal drinking age, it is your full responsibility. 

If you are buying one of our alcoholic products intended to be given to someone else, regardless the purpose, both you and the recipient confirm to be of legal drinking age.

Through the check out process you will have to confirm your date of birth. This will determine whether or not you are allowed to order products at our store. This date of birth will be printed on the invoice. The transporter, be it a courier or any other sort of company, will ask for your date of birth when delivering the parcel. If the answer does not match the printed date, he / she will not deliver the parcel. If needed the transporter has the right to request for identification. If this request is not fulfilled, the transporting company has the right to cancel the actual shipping. We (Belgian Beer Factory) as well have the right to ask for identification at any time, in order to protect minors. 

IMPORTANT : You can find our contact details all over our shop. In almost all cases these contact details are used for assortment or order related questions. If you have any questions regarding the use or abuse of alcohol, you can of course also contact us.

HOW TO ORDER

Throughout our entire web shop you can access certain product pages. These pages enable you to purchase the concerning product. When being interested in buying such product, you simply hit the ‘Add to Shopping Cart’-button. You, as a customer, even have the ability to add more products to the shopping cart. Clicking on the shopping cart icon gives you an overview of all the added products. Then you can proceed to the checkout. Here we will ask for all sorts of date / personal info in order to make a successfull delivery possible. Here you can also select the wished for delivery and payment method. All you have to do is accept our terms and conditions and confirm the order. The next step involves the payment. Once the payment has been completed you will receive a confirmation mail. More about the actual payment can be found in ‘4. Payments’. When the actual order will be sent out, you’ll once again receive a confirmation with a unique track and trace code.

The process above is the most common way to order products on www.belgianbeerfactory.com. When indicated so, Belgian Beer Factory also offers all sorts of other ways (by mail...) to order specific products. Thus a customer isn’t restricted to just this one process. 

If the web visitor or customers enters the wrong information, Belgian Beer Factory can't be held responsible for possible extra charges. It is the customer's responsibility to add his/her information correctly. If our DPD Labeling system indicates incorrectly entered information, we will immediately contact the customer in order to verify the shipping details.

PAYMENTS

     1.     Our Price Indications

All prices of our products with delivery in Belgium, the Netherlands or DE include your local VAT, excise duties and local empties costs. The sale of our beer glasses to all other countries is subject to Belgian tax as long as the thresholds for distance sales are not reached.

All our product prices exclude the shipping charges. Those shipping charges will be added later on in the checkout process, depending on multiple parameters. For more information about this topic, we refer to our 'Taxes' page.  

Businesses as well have the ability to order certain products, but please note that only Belgian VAT registered companies can order through our shop. Other, non Belgian VAT registered companies better contact us first by email. 

Belgian VAT-registered businesses will be charged with both Belgian VAT rates and excise duties. If the particular business has a valid VAT-number, Belgian Beer Factory will draw up an invoice.

     2.     Payment Methods

All payments are made possible by both Multisafepay and Paypal.  Here you have an overview of all our payment methods :

The payment takes place in the checkout process, after which the customer has indicated the wished for payment method. The actual payment will be processed by Multisafepay and Paypal. Therefore we advise you to check their Terms and Conditions as well. 

TAXES

The prices displayed on Belgian Beer Factory.com all included the needed taxes. Please note that the taxes depend on the country of delivery. Here you have an overview :

1. Delivery to BE, NL and DE : These product prices include the local VAT, excise and deposit cost of the country of destination. We will declare all these taxes for you.

2. Deliveries to all other EU-member states : We only ship non-alcoholic products to these countries and therefore the customer will be charged with Belgian VAT as long as the local VAT treshhold of distance selling of products has not been reached. If this treshhold has been reached, we will declare local VAT for you.

3. Deliveries outside of the EU : If the customer is based outside of Belgium, you will be charged with 0% Belgian VAT and without Belgian excise and deposit costs if the country of delivery is based outside the EU. Even if the product page or checkout mentiones something else. Upon delivery, the customer will be charged with local taxes at local rates. Belgian Beer Factory is in no way responsible for these local taxes. The actual declaration cost is already included in the shipping cost. But please note that if the customer is based in Belgium and he/she is willing to send an order as a gift to an address outside of the EU, that in that case the Belgian customer will be charged with 21% Belgian VAT and Belgian excise and deposit.

SHIPPING

     1.     Arrival of the goods

After you’ve placed an order and consequently received an order confirmation, the actual order will be handled by Belgian Beer Factory. From this confirmation on, the purchase agreement between the customer and Belgian Beer Factory has become valid. After a few days you will receive a status update. The actual time of arrival of the goods will of course be influenced by the shipping address, availability of the products, time of the year ... Further indications can be found on our website. These indications are mere informative. Please ensure that you are available on the indicated day of arrival of your goods.

Throughout the checkout process Belgian Beer Factory will ask for the customer’s contact details. Adding these details is the customers responsibility and when being inputted incorrectly, Belgian Beer Factory can’t be held responsible. Some of these details will be transferred to the transporter in order to provide the best service as possible. By doing so, Belgian Beer Factory commits to fully respect the privacy policy. We refer to our privacy disclaimer page.

Belgian Beer Factory will do everything within its power to make sure your goods arrive in time. Nonetheless we are not liable for any delay outside of our control. Therefore we demand your understanding.

Even though your purchased goods will be packed properly, it’s possible that your goods get lost or damaged. In case this unfortunate situation occurs, please contact us at info@belgianbeerfactory.com , together with photos and sufficient information and choise of courier service company. We will contact the concerning transporting company and offer a replacement, a refund or another solution. 

     2.     Shipping cost

The shipping cost can be found in the checkout process and on our 'Shipping' page. Throughout the checkout process Belgian Beer Factory won’t charge extra, other than the shipping charges.

     3.     Custom Obligations

Belgian Beer Factory follows and respects all national and international laws concerning distance selling, selling alcoholic beverages ... But regardless the fact that you are an end-consumer, a Belgian- or non-Belgian VAT-registered business, Belgian Beer Factory is never responsible for the obligations you have towards local authorities. By visiting our website or by ordering products you agree with this term and you acknowledge that it’s your responsibility. For shipments with destinations outside the EU, the end-consumer is the importing party instead of BBF the exporter. Therefore the end-consumer is responsible for the importation and the customs. If a parcel is seized by your local customs it is your responsibility to clear the shipment. Obviously we will do everything to help you on this matter, but it is outside of our responsibility. If the parcel is send back to our warehouse and the end-consumer wants a refund, we can only refund the money for the undamaged returned products and not for the shipping cost, returning cost ...

Belgian Beer Factory can in no way be held responsible if the shipment is detained or confiscated by the local authorities. We have fulfilled our obligations towards our and your local authorities. Even though Belgian Beer Factory fully protects your privacy, it is perfectly possible that local customs opens your package in order to check its content. Unfortunately this is beyond our control and so it falls outside our responsibility. This might cause a certain delay in time of arrival. When such an inconvenience occurs, please contact your local customs office. 

Obviously the customer has the ability to return empties after consuming the concerning contents. In this case the customer is responsible for the packaging and shipping cost of the returning empties. Once the empties have been received by us, we will refund the concerning deposit cost back to the customers account. 

       4.  DPD Parcelshops

We can ship your parcel to a regular address (home address, the company you work...), but we can also ship your order to a DPD Parcelshop. Please note that in this case it is the customers responsability to collect the parcel in time. In general you have to pick up the parcel within 4 working days after the parcel arrived at the DPD Parcelshop. If not, the parcel will be returned to our warehouse. In that case we will charge the returning cost and new shipping cost. If the customer prefers a refund, then we will refund the the total order amount minus the shipping and returning cost.

HOW TO CANCEL OR RETURN AN ORDER? (RIGHT OF WITHDRAWAL)

Every customer has the right to cancel their order or to return their order within 14 days after arrival. Officially this is what they call the 'Right of Withdrawal'. This right only applies to our assortment of non-expiring, non-damaged or non-personalized goods. Possible shipping charges for sending back the concerning order are to be paid by the customer and not by Belgian Beer Factory. Belgian Beer Factory will refund within 30 days after which we’ve received the concerning order only if this order appears to be complete and undamaged.

Once an order has not arrived and a complaint has been filed towards Belgian Beer Factory, Belgian Beer Factory will investigate the matter. During that period of investigation Belgian Beer Factory will not reimburse the payment or provide a second delivery. Once the matter has been cleared, Belgian Beer Factory might offer to reimburse or to send out a second delivery.  Of course Belgian Beer Factory commits to inform the concerning customer in time and promptly.

DAMAGED OR INCOMPLETE DELIVERY

When the order arrives, it’s the customer’s responsibility to check if the order is complete and undamaged. If not, the customer is to indicate the damaged or incomplete goods on the delivery note, together with his signature within 14 days after the delivery. Thus the customer is able to ship the concerning order back, after which Belgian Beer Factory will reimburse the customer. Only damaged, incomplete or not personalised orders can be reimbursed by Belgian Beer Factory.

If not indicated correctly on the delivery note, the customer accepts the order irrevocably and admits that Belgian Beer Factory has met its obligations. This acceptance involves the fact that from now on the goods  are the customer’s responsibility.

Within the period of 14 days after which the delivery note has been signed, the customer can send their order back. Belgian Beer Factory won’t charge extra, other than the actual shipping expenses. Belgian Beer Factory guarantees a reimbursement within 30 days for the resalable goods after which the goods arrive at our warehouse.

COMPLAINTS

When having complaints or questions about the service, the invoice, the arrival etc. please contact us by mailing at info@belgianbeerfactory.com within 8 days after which you’ve received your order confirmation. We will respond to this complaint or question as soon as possible.

All disputes fall under the exclusive jurisdiction of the Belgian courts competent for our headquarters. Information about alternative dispute resolution can be found via this link: http://ec.europa.eu/odc/ but we reserve the right to submit disputes exclusively to the Belgian courts. 

INTERNET IS NOT ALWAYS SECURE

Belgian Beer Factory can’t guarantee the privacy of your communications or the visits to our websites, platforms, networks etc., seeing the insecure nature of the internet. By using the internet in order to access our online websites, platforms, networks etc. the customer acknowledges the risk of data corruption, unauthorised access, interceptions and delays. Of course Belgian Beer Factory will do everything within its power to minimize these risks. If your personal hard- or software gets damaged while visiting our websites, platforms, netwerks etc., we can't be held responsible. This is what they call consequential damage and is mostly due to causes outside our responsibility. 

Belgian Beer Factory or any person involved in its operations can make changes to the online content, whenever needed. These changes can be made by Belgian Beer Factory without notice.

Since we sell tangible consumer goods, consequential damage isn't invincible. It is perfectly possible that products sold by Belgian Beer Factory damage you or possible third parties, in no way Belgian Beer Factory can be held responsible for. E.g. : You just received your order, but unfortunately the heavy box falls on your foot. This is outside our responsibility and so Belgian Beer Factory can't be held responsible for such consequential damage.

When this occurs, Belgian Beer Factory can’t be held responsible for the other online properties being linked at. THE USE OF OUR GOODS

     1.     Alcoholicity

Seeing the fact that we mainly sell alcoholic products, we are aware of the potential risks these products implicate. Therefore we strongly advice to consume our products well considered. More information about the exact drinking age can be found in ‘Legal Drinking Age’.

     2.     Expiring Date

Most of our products have an expiring date. When the products you ordered have expired on arrival, you will be recompensated for this. More about how to return other, not expiring products can be found in ‘6. How to Cancel or Return an Order’.

Throughout the checkout process you will have to indicated whether you buy as a private or professional customer. In both cases you are responsible for this choice and consequential obligations this involves. In other words, if you indicate to be a private customer, the goods are in no way to be resold. If you decide to resell these products, we are in no way responsible for the consequences, duties, confinements and responsibilities you have towards the autorities. In case you place an order as a professional customer you are responsible for the obligations you have towards the authorities. In no way can Belgian Beer Factory be responsible for the obligations you have towards the authorities. 

The same for when you receive your order and you ship the products to other destinations as a gift for example. In that case you are also responsible for the obligations you have towards the authorities. This is for both the private and professional customer. 
 

Belgian Beer Factory'S PROPERTY

     1.     Products

As long as the actual payment hasn’t been completed, the concerning goods still remain Belgian Beer Factory's property. Nonetheless the customer will be held responsible for those goods, from the moment on when the goods have been picked up at our warehouse, whether or not the payment has been completed. Once the payment has been completed the ordered products become property of the concerning customer. 

Once the payment has been completed we will be able to ship your order. Therefore Belgian Beer Factory will never own beers outside the Belgian territory. Meaning that from the moment when the payment has been completed, the order is fully property of the customer.  

Please note that if some products in our beer boxes are not available at that time we will choose replacement beers. 

     2.     Intellectual Property

All photos, information, logo’s, content, graphics etc. to be found on our online websites, platforms, networks etc. are Belgian Beer Factory property. When being used for purposes other than the viewing of information or ordering purpose, the use is prohibited. Only with written permission of Belgian Beer Factory this use is allowed. In the past we have seen unrightfull use of our online property. Therefore we will take steps when such situations happen.

DISCLAIMER

Visiting our websites, platforms, networks etc. is at your own risk and Belgian Beer Factory can’t be held responsible for the actual content. All the information shared on our properties is mere informative and Belgian Beer Factory can’t be held responsible for a probable incomplete, inaccurate, unreliable, unsuitable or unavailable nature of the content.

These terms and conditions apply to your visits and use of our online property and your possible orders. Belgian Beer Factory has the right to change these terms and conditions at any time. Therefore we advise you to check our terms and conditions regularly and not to assume that the same terms and conditions apply to future orders or visits. Corrected or adjusted terms and conditions will of course be deleted and replaced by new ones.

      2.  Concerning our entire website

All the information displayed on our entire website is mere temporary and we cannot exclude future changes to be made to our website. Belgian Beer Factory has the right to change this information and therefore we cannot be held responsible for former information. Therefore we advise you to regularly check our website and Terms and Conditions before using it again. Since we are constantly 'under construction' we ask your understanding and if you may have any questions or remarks about this fact, please contact us by mailing at info@belgianbeerfactory.com.

Also, please note that breweries constantly change the 'look and feel' of their products, logo's ... Please note that if a sudden change has been made, it takes time for us to adapt to this new situation. E.g.: If a brewery uses new labels or new glasses, the images on our webshop may still display the product from before. We will do our very best to change this asap, but please note that we cannot be held responsible for this.

COMMUNICATIONS

In order to inform the customer we can communicate by mail (Gmail...), our networks, platforms... The communicated content is merely informative and is in no way binding for Belgian Beer Factory or a third party. We are also not responsible for malfunctions or shortcomings of these mediums. This is outside of our power.  

SUPPLIERS OF E-CONNECT SERVICES

E-Connect Services can never be held responsible for the obligations our suppliers have towards the authorities. Here it concerns both the Belgian and non-Belgian authorities. This is especially the case with the VAT-declarations our suppliers have to make concerning our orders. In no case can we be held responsible for this. 

We only use our mailing account to place orders with our suppliers. By replying to our mails or by confirming our order, you agree with our Terms and Conditions.
 

APPLICABLE LAW

These terms are governed solely by Belgian law and the courts of the legal district of Antwerp have exclusive jurisdiction.

MARKET PLACES

Products displayed on third party market places referring to our shop can only be sold for the sales price on our shop and not on the market place.
